Welcome to THE UPPER LOOM! These Terms of Service ("Terms") govern your use of our website and online store. By visiting, browsing, or making a purchase, you agree to be bound by these Terms. If you do not agree, please do not use our services.
1. Our Business THE UPPER LOOM is a small handmade boutique owned and operated by Jessie Stern in Nashville, Tennessee, USA. We specialize in unique, handcrafted items made with care, often using specialty materials such as variegated yarns.
2. Products and Handmade Nature All products are handmade and one-of-a-kind. Slight variations in color, size, shape, texture, or appearance are normal and expected in handmade goods.
Variegated Yarn Disclaimer: Items made with variegated yarn may differ significantly in color placement, striping patterns, and overall appearance from the product photos. These natural variations are a feature of variegated and hand-dyed yarns and are not considered defects.
We make every effort to represent our items accurately with multiple photos and detailed descriptions, but minor differences may occur. Please read the full product description, measurements, materials, and care instructions carefully before purchasing.
3. Pricing and Payment All prices are shown in USD and are subject to change without notice. Applicable taxes will be calculated at checkout. We accept payment through Shopify Payments and other integrated methods. You represent that the payment information you provide is accurate and authorize us to charge your chosen payment method.
4. Orders and Fulfillment Your order placement is an offer to buy. We reserve the right to accept or reject any order for any reason, including pricing errors or stock issues. Processing and shipping times are estimates only and not guaranteed.
5. Returns & Refunds Policy Because each item is handmade and unique, all sales are final. We do not accept returns, exchanges, or refunds for change of mind, sizing/fit issues, color variations (including variegated yarn patterns), or personal preference.
Limited Exception for Damaged or Defective Items If an item arrives significantly damaged due to a clear manufacturing defect (and not due to normal handmade variations, shipping damage after delivery, customer handling, or wear and tear), please contact us within 5 days of delivery.
You must provide clear, well-lit photos showing the specific issue. We will review each request on a case-by-case basis and, at our sole discretion, may offer a repair, replacement, or store credit for the purchase price of the item only (shipping costs are non-refundable).
Store credit expires 60 days after issuance and cannot be redeemed for cash or transferred. We do not issue refunds to the original payment method.
Custom, personalized, or made-to-order items are strictly non-returnable and non-refundable under any circumstances.
Any shipping damage must be reported directly to the carrier (USPS, UPS, FedEx, etc.) promptly, as we are not responsible for carrier handling once the package leaves our studio.
By completing your purchase, you acknowledge and agree to this Returns & Refunds Policy.
6. Intellectual Property All content on this website — including product photos, descriptions, designs, logos, and branding — is owned by THE UPPER LOOM or its licensors. You may not copy, reproduce, distribute, or use any materials without our prior written permission. Our handmade items are sold for personal use only.
7. Limitation of Liability To the maximum extent permitted by law, THE UPPER LOOM will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our site or products. Our total liability for any claim shall not exceed the amount you paid for the specific item involved.
We do not warrant that our handmade products are suitable for every intended use or free from all possible variations inherent to handmade items.
8. User Conduct You agree not to misuse our website, engage in unlawful activities, or interfere with its operation. We reserve the right to refuse service or terminate access for violations of these Terms.
9. Changes to These Terms We may update these Terms from time to time. The updated version will be posted here with a new effective date. Your continued use of the site after any changes constitutes acceptance of the revised Terms.
10. Governing Law These Terms are governed by the laws of the State of Tennessee, without regard to its conflict of laws principles. Any disputes arising from these Terms or your use of the site shall be resolved exclusively in the state or federal courts located in Davidson County, Tennessee.
